Distance agreement is the contract between CUSTOMER (PTAL 1. section 3. poin) and SELLER (PTAL 1. section 5. point) or SERVICE PROVIDER (PTAL 1. section 4. point), based on the offer of the vendor or service provider whether addressed or not addressed printing, letterhead, catalog, advertisement published in the press, to which an order coupon is attached, telephone, facsimile, Internet, electronic mail, television, radio, etc. through means of sending or transmitting information. The distance agreement applies to orders and purchases made in the online store or with delivery, but does not apply to those purchases made in SELLER’s physical stores.
A distance contract comes into force as soon as the CUSTOMER places an order on the Internet, by telephone, with the help of other technological means, and receives confirmation from the SELLER via e-mail. The order confirmation and the order itself are considered received when they are available to parties to whom they are addressed.
The SELLER undertakes to fulfill the terms of the distance agreement no later than 30 days after receiving the order from the CUSTOMER, unless the contracting parties have agreed on a different term. If the SELLER cannot fulfill the agreement because the product ordered by the CUSTOMER is not available, the SELLER is obliged to inform the CUSTOMER about this. In this case, the SELLER can offer the CUSTOMER an equivalent product at an equivalent price.
According to the Customer Protection Law of the Republic of Latvia , the Customer has rights for unilateral withdrawal from the contract within 14 calendar days and return the purchased product to the SELLER.
The CUSTOMER cannot use his rights for unilateral withdrawal when:
The CUSTOMER is responsible for the quality and safety of the product, while his/her rights for return are being executed.
When returning the purchased product, the CUSTOMER must present a document confirming the purchase. According to the distance agreement, the CUSTOMER has rights to return the product within 14 calendar days from the receipt of the product. The SELLER is responsible to return funds within 15 working days. If the CUSTOMER wants to return a product that does not meet the distance agreement, then according to the Cabinet of Ministers of the Republic of Latvia regulations No. 255, the CUSTOMER must fill out a request application form and return the product in a complete original set.
